Preamble
These General Terms and Conditions of Sale (hereinafter the “GTC”) govern the sales carried out on the website www.sophiedere.com to consumers.
Any order placed on the Website implies full and unconditional acceptance of the GTC in force on the date of the order. The Customer declares that they have the legal capacity to enter into a contract.
1. Seller identification
Sales are carried out by the company Osez Sophie – SARL, operating under the brand Sophie de Ré, with a share capital of €7,500, registered with the Trade and Companies Register of La Rochelle under number 494 910 227, whose registered office is located at: 1 rue Baron de Chantal – 17410 Saint-Martin-de-Ré – France.

2. Purpose and scope
These GTC define the rights and obligations of the parties in the context of the online sale of products offered on the Website to any natural person acting for non-professional purposes.
Osez Sophie – SARL reserves the right to modify these GTC at any time. The applicable GTC are those in force on the date of the order.
3. Products
The products offered are those displayed on the Website, subject to availability. Essential characteristics are described on each product page.
Photographs are non-contractual and may show slight differences compared to the delivered product.
4. Prices
Prices are indicated in euros, all taxes included (VAT included), excluding delivery costs. Delivery costs are specified before final validation of the order.
The applicable price is the one displayed at the time the order is placed.
5. Geographical area
Sales are available for delivery in mainland France and certain European countries. The deliverable areas are specified during the ordering process.
6. Order
The Customer selects the products, checks their cart, and then validates the order after accepting the GTC. Validation and payment constitute an electronic signature and acceptance of the contract.
The information provided when placing the order is binding on the Customer. In the event of an error, any resulting consequences (delay, impossibility of delivery, additional costs) may be charged to the Customer.
7. Payment
Payment is due at the time of ordering. Payments are made by bank card via a secure environment, including enhanced authentication where required.
8. Delivery
8.1 Terms
Deliveries are made to the address provided when the order is placed. Shipments are made from Monday to Friday, excluding public holidays.
8.2 Delivery times
Delivery times are provided for information purposes only: 3 to 5 working days for mainland France, and 5 to 7 working days for the European Union. Certain personalized products may require additional time.
8.3 Transfer of risk
The risk of loss or damage is transferred to the Customer when the Customer, or a third party designated by them, physically takes possession of the product.
9. Right of withdrawal
9.1 Principle
The Customer has a period of 14 days from receipt of the product to exercise their right of withdrawal, without having to provide any reason.
9.2 Refund
The refund will be made within a maximum of 14 days from receipt of the returned product or proof of shipment, using the original payment method.
9.3 Returns
Return costs are borne by the Customer. Products must be returned in perfect condition, suitable for resale.
9.4 Exceptions
The right of withdrawal does not apply to personalized products or products made according to the Customer’s specifications.
10. Retention of title
Products remain the property of Osez Sophie – SARL until full payment has been received.
11. Legal warranties
11.1 Legal warranty of conformity
The Customer benefits from the legal warranty of conformity allowing repair, replacement, or reimbursement of the product under the conditions provided by law.
11.2 Warranty against hidden defects
The Customer also benefits from the warranty against hidden defects.

13. Liability
The Seller is responsible for the proper performance of the contract. Its liability cannot be engaged in cases of force majeure or improper use of the products by the Customer.
14. Intellectual property
All elements of the Website are protected by intellectual property rights. Any reproduction without authorization is prohibited.
15. Personal data
Personal data is processed in accordance with the Privacy Policy available on the Website. It is used solely for order management, delivery, and customer service.
16. Archiving and evidence
Computerized records constitute proof of transactions between the parties.
17. Consumer mediation
In accordance with legal provisions, the Customer may use a consumer mediator free of charge after a prior written complaint to customer service. The contact details of the competent mediator will be provided to the Customer upon request.
18. Governing law and disputes
These GTC are governed by French law. In the event of a dispute, the Customer may refer the matter to the competent court in accordance with applicable rules.
